Terms of Use
These terms govern the use of blackgrove.ca and the online processes offered by BlackGrove, including viewing listings, requesting information or visits and accessing digital rental services. They do not replace your lease or limit any right that cannot legally be waived.

1. Identity and scope
In these terms, ‘BlackGrove’, ‘we’, ‘us’ and ‘our’ refer to 9373-4630 Québec inc., operating as BlackGrove, whose office is located at 626 Victoria, Saint-Lambert, Quebec J4P 2J6.
BlackGrove may act as owner or as manager on behalf of an owner. The landlord concerned is identified in the applicable contractual documents. Presenting a property on our website does not necessarily mean that the entity operating the website owns it.
Some features are provided by external companies and may be subject to their own terms, presented when you use them.
2. Reviewing and accepting terms
These terms are available on our website. Where a process requires contractual acceptance, the relevant terms are presented before you commit and your acceptance is obtained at the appropriate time.
Accepting these terms does not provide general authorization to carry out personal checks, debit funds or send promotional communications. Required authorizations are requested separately.
To carry out a process that binds another person or a business, you must have the necessary authority.
3. Listings and property information
We strive to present accurate, current information. Availability, advertised rents, inclusions, areas and occupancy dates may change before an agreement is entered into.
Photographs, plans and renderings may show a representative unit, a proposed layout or a project under development. Relevant differences must be explained in the listing or in your communications with our team.
Before making a commitment, have the features and conditions specific to the unit concerned confirmed. Please report any error you notice.
Correcting or updating a listing does not amend an agreement already entered into or the rights provided by law.
4. Inquiries and visits
An inquiry, registration of interest or visit booking does not, by itself, reserve a unit, approve an application or create a lease.
Please provide accurate contact details and let us know if you need to change or cancel a visit.
The effects of any separate offer, promise or other commitment depend on its content and the applicable law.
5. Applications and checks
Applications may be processed through Kompas PM. Information requested must be accurate to the best of your knowledge. Please notify us of any error or material change.
Checks are limited to those necessary and permitted by law. Their nature and the required consents are presented to you at the appropriate time.
Submitting an application or authorizing a check does not guarantee that a unit will be allocated to you. The application is assessed by the landlord concerned or its authorized representative in accordance with applicable laws, including privacy and non-discrimination requirements.
6. Rentack and Kompas PM
We use Rentack to publish listings and receive initial inquiries.
We use Kompas PM for application and tenancy management processes, including checks, leases, signatures, payments and the tenant portal.
These services may involve other providers, including for electronic signatures and payment processing. The terms applicable to these features are presented by the service concerned.
Kompas’s terms of service govern your use of its platform. They are separate from these terms and your lease.
BlackGrove remains your contact for matters within its management responsibilities: listings, applications, the lease, your rental account and requests relating to the building. Technical issues may also require the involvement of the relevant provider.
7. Account and security
When using an account, protect your login credentials and avoid sharing them. Use authorized access mechanisms to allow a representative to act on your behalf.
Promptly notify the support team of the service concerned and BlackGrove if you suspect unauthorized access or fraudulent use.
You must not impersonate another person, knowingly submit false information, attempt to access another person’s records, circumvent security measures or disrupt the services.
8. Lease and electronic signature
Read documents presented for signature before accepting them. Contact us if you have a question or notice an error.
An electronic signature may create legal obligations. The signing process and access to signed documents are presented in the service used. Keep a copy of your documents.
These terms do not authorize unilateral changes to a lease. The rules governing its formation, renewal, amendment and termination remain those of the lease and the law.
9. Payments
Amounts due, due dates and payment terms are determined by your lease or another valid agreement, subject to the law.
Accessing the portal or accepting these terms does not authorize a debit. Pre-authorized payments require separate authorization under the applicable arrangements.
Before confirming a payment, check the amount, recipient and any displayed fees. A fee is not payable merely because it appears in an interface: it must be permitted by law and validly applicable to your situation.
Promptly report any incorrect, declined or duplicate payment. If the system is unavailable, contact us to arrange a payment method consistent with the lease and the law.
A portal failure does not automatically change the rent due date; nor does it, by itself, determine either party’s liability.
10. Communications and maintenance requests
The portal may be used to exchange messages, send documents and submit maintenance requests. Processing times depend on the nature and urgency of the request.
The portal and the general contact form are not emergency services. Use the emergency contact details provided for your building. If there is an immediate danger, contact the appropriate emergency services.
The presence of a message in the portal does not necessarily establish valid delivery of a legal notice. Notices relating to the lease must meet applicable requirements for content, transmission, deadlines and proof of receipt. Required consent for electronic communications is obtained at the appropriate time.
11. Availability and suspension
Interruptions may occur because of maintenance, technical issues or events beyond our control.
Access to a service under our control may be restricted where reasonably necessary to protect security, prevent fraud, comply with the law or stop misuse. Where circumstances permit, we inform you of the reason and the steps to restore access.
Suspending or closing a digital account does not terminate your lease or remove your rights. Contact us to access necessary documents and continue tenancy-related processes through another appropriate channel.
12. Website content
The website’s text, photographs, plans, logos and other elements belong to BlackGrove or their respective rights holders.
You may view them and retain information useful for your personal purposes. Other reproduction or use requires the relevant rights holder’s permission, except where permitted by law.
This provision does not restrict your right to retain your contractual documents, exercise your rights or send documents to your advisers or competent authorities.
13. Privacy
Our Privacy Policy explains how your personal information is processed.
Additional notices may be presented in Rentack, Kompas PM or associated services. Please consult them at the time of the process concerned.
14. Liability
Each party remains responsible under applicable legal rules. Using an external provider does not remove the obligations of BlackGrove or the landlord.
We do not guarantee continuous, error-free access to digital services. This statement does not waive your remedies or exclude legal duties regarding security, confidentiality or diligence.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for bodily or moral injury, or for material injury caused by intentional or gross fault.
15. Applicable law and recourse
These terms are governed by the laws of Quebec and the federal laws of Canada applicable there.
You may contact us to try to resolve a difficulty. Doing so does not prevent you from applying to a competent authority, including the Tribunal administratif du logement or the Commission d’accès à l’information, depending on the dispute, and does not suspend legal deadlines.
If a provision is declared invalid, the others continue to apply to the extent permitted by law. Mandatory rights and lease obligations remain protected.
16. Changes
We may update these terms to reflect changes in services or applicable law.
The updated version indicates its effective date. A material change affecting existing users is accompanied by appropriate notice; new acceptance is requested where necessary.
Changes do not apply retroactively to commitments already made and do not amend your lease.
